The Grounds for Divorce in NY & NJ
New York does not recognize “irreconcilable differences” as grounds for divorce even if both spouses agree. New Jersey does.
The law requires that you have grounds (reasons) for the divorce.
Grounds For Divorce in New York
The grounds for divorce in the State of NEW YORK are:
- Abandonment (for a period of one or more years):
a. Constructive Abandonment = refusal of spouse to have sexual relations
b. Actual Abandonment = spouse has left home
- Confinement of your spouse to prison for a period of three or more consecutive years or a mental institution for five years beginning after the marriage;
- Adultery - voluntary sexual intercourse with a person other than your spouse;
- Living separate and apart for one year or more pursuant to a judgment or decree of separation or a written separation agreement after proof has been made that all terms have been substantially complied with;
- Cruel and inhuman treatment in which the conduct of the wrongdoing spouse endangers the physical or mental well being of the other spouse and makes it unsafe or improper for the parties to reside together.
Grounds For Divorce In New Jersey
The grounds for divorce in the State of NEW JERSEY are:
- Desertion (for a period of one or more years):
a. Constructive = refusal of spouse to have sexual relations
b. Actual Desertion= spouse left home
- Confinement of your spouse to prison for a period of eighteen or more consecutive months or in a mental institution for twenty four or more months beginning after the marriage;
- Adultery - voluntary sexual intercourse with a person other than your spouse;
- Living separate and apart for eighteen months with no reasonable chance for reconciliation;
- Habitual drunkenness [or drug use] for 12 or more months after the beginning of the marriage;
- Deviant sexual conduct without the consent of the spouse;
- Extreme cruelty - conduct of the wrongdoing spouse endangers the physical or mental well being of the other spouse and makes it unsafe or improper for the parties to reside together;
- Irreconcilable differences
