Frequently Asked Questions

Find straightforward information about our process, services, and what to expect when working with our firm.
How do I know if I have a valid personal injury claim?

If you suffered physical injury and financial losses in an incident caused by another party’s negligence, then you likely have a valid personal injury claim. Personal injury cases can involve traffic collisions, injuries on someone else’s property, malicious acts (like an assault), and medical errors. The defendant may be either a person or an entity, such as a consumer product manufacturer or a hospital. Plaintiffs (the injured party) in personal injury claims are entitled to compensatory damages to cover medical expenses, lost wages, property damage, pain and suffering and loss of quality of life.

Can I still recover damages if I was partially at fault?

Yes, depending on your state’s comparative negligence laws, most plaintiffs can still recover monetary damages even if they contributed to the incident. New York operates under a pure comparative negligence rule, allowing injured persons to recover compensation even if they contributed up to 99% of the fault for the accident. New Jersey, by comparison, operates under a modified comparative negligence rule, in which plaintiffs can only recover compensation if they contributed less than 50% of the blame for the accident.

How do I join a class action lawsuit?

If you meet the class definition (purchase of a product, receipt of medical treatment, etc.), then you may automatically be included if you meet the class definition, unless you opt out. If you have been hurt or developed a medical condition due to the use of a malfunctioning or contaminated consumer product, for example, or suffered financial loss due to a data breach, you may be able to search for an existing class. Many class action attorneys list the class actions they are participating in on their websites, such as one filed against Amazon (employment and wage law violations and consumer product liability) or one against PharMerica (a data breach).

Is it worth it to join a class action lawsuit?

Joining a class action lawsuit is often worth it if you’ve been harmed by a defective product, pharmaceutical error, data breach, or corporate misconduct. When you participate in a class action, you benefit from collective legal power without bearing the full cost of litigation individually, most class actions operate on a contingency fee basis, so you don’t pay attorney fees unless there’s a recovery. Class actions are particularly valuable when individual damages might be too small to justify a solo lawsuit, but the aggregate harm across all victims is substantial enough to hold large corporations accountable. By joining together with other affected consumers or investors, you increase the likelihood of securing meaningful compensation and preventing companies from continuing harmful practices that might otherwise go unchallenged.

The process is typically straightforward, requiring minimal effort on your part while experienced class action attorneys handle the complex litigation. If you believe you’ve been affected by widespread corporate wrongdoing and are considering whether to join a class action, contact our office at (866) 971-0927 to discuss whether participating in an existing case or initiating new litigation makes sense for your situation.

How is property divided in a divorce?

Property division in divorce can be one of the most complex aspects of marital dissolution, depending on your state’s laws and the unique circumstances of your marriage. We help clients navigate the division of marital assets, including real estate, retirement accounts, investments, businesses, vehicles, and other property acquired during the marriage. In New York and New Jersey, courts follow “equitable distribution,” meaning assets are divided fairly (though not necessarily equally) based on factors like the marriage’s length, each spouse’s income and earning potential, contributions to the marriage, and financial needs. Separate property acquired before marriage or through inheritance generally remains with the original owner, though commingling assets can complicate matters. Our divorce attorneys work diligently to safeguard your interests during property settlement negotiations, ensuring you receive a fair share while protecting what’s rightfully yours. If you’re facing divorce and have concerns about property division, contact our office at (866) 971-0927 to discuss your situation and develop a protective strategy.
