Police are still searching for the truck involved in an accident that killed a Bergen County man on March 9th. The driver allegedly fled the scene. The semi-truck is either red or maroon, according to a surveillance video. Mario Andres Uran Gaviria, 41, Elmwood Park, died after his motorcycle and a truck collided in Rochelle Park at 8:40 p.m. The accident occurred on Route 17 South near Fairview Avenue.
According to Bergen County Prosecutor Mark Musella, the victim was found by responding officers in the southbound lane. He had suffered severe head trauma. Gaviria was later pronounced dead at Hackensack University Medical Center. Officials said the motorcycle was behind the truck when it slowed down due to traffic ahead. Gaviria was unable to stop his bike in time and ran into the truck’s rear left tires. The semi-truck continued onward after the collision. A GoFundMe campaign has been launched to help the family of Gaviria, a husband, and a father.
Truck Accidents
Truck accidents can often cause severe and even fatal injuries. The occupants of a smaller vehicle have little protection. Severe head trauma, as happened in this case, is a frequent injury. Other common injuries include:
- Burns
- Internal organ damage
- Multiple fractures
- Spinal cord damage
Liability for a truck accident may go beyond the driver and trucking company, depending on the crash. For example, if the accident happened due to a vehicle defect, the manufacturer may prove responsible. The same would be true for a freight company– if improperly loaded cargo contributed to the accident.
A car accident attorney from Kantrowitz, Goldhamer & Graifman P.C. can help family members pursue a wrongful death lawsuit when a loved one is killed due to another driver’s recklessness or negligence. Wrongful Death Lawsuit
Nothing can bring your family member back– but a wrongful death lawsuit can provide a financial cushion for survivors. A surviving spouse and children may file this type of lawsuit. If the decedent did not have a spouse or children, surviving parents might file.
Damages in a wrongful death lawsuit may include:
- Reasonable funeral and burial costs
- Loss of income
- Loss of services
