According to the Associated Press, Clint Eastwood’s second wife filed for legal separation last week from the movie star.
The AP reported that Dina Eastwood filed a petition to separate from Clint in the Monterey County Superior Court in California. In her petition, she is seeking spousal support and physical custody of the couple’s 16-year-old daughter Morgan.
The AP reported that the filing indicated that the couple has a premarital agreement. The couple has been married since 1996. Previously, Eastwood was married to Maggie Johnson, from 1953 to 1984.
A legal separation is different from a divorce in that you can remain married to a person even though you are separated. Some people choose to remain married due to religious beliefs, and to extend benefits including Social Security, taxes and retirement plans.
In some states, there are laws in place following a marriage that require waiting periods before a divorce can occur, making legal separation an option. There are also cases where a person may still believe there is a possibility they will get back together with their spouse, so a legal separation makes more sense.
In any case involving a separation or divorce, we would suggest working with an experienced family attorney who can help you protect yourself when it comes to issues like child custody and visitation, division of marital assets, alimony and child support and prenuptial and postnuptial agreements.
