According to the New York Daily News, Sherri Shepherd, a co-host on ABC’s “The View”, has filed for divorce from her husband in New Jersey.
The filing reportedly comes several days after her estranged husband Lamar Sally filed for a legal separation in California.
In her filing, Shepherd did not specify anything related to custody of her and Sally’s unborn child, which they are having via surrogacy, according to the Daily News.
In his filing, Sally requested custody of the baby and only wants his wife to have visitation rights. In Shepherd’s filing, she indicated she wants her prenuptial agreement to be enforced, while Sally has requested that it be invalidated based on “fraud”.
Gossip site TMZ reported that the couple’s agreement specifies that he only receive $60,000 if the marriage lasts between two and five years. The couple has been married for three years.
How Do I Modify or Seek a Change in a Prenuptial Agreement?
Prenuptial agreements, also known as premarital agreements, define which assets belong to each spouse should a marriage end. It should be noted that these agreements can be modified, enforced, challenged and defended by an attorney for various reasons, including adultery, fraud and/or other problems that develop over the course of a marriage.
You should not shy away from a divorce because of an outstanding premarital agreement. A skilled lawyer can often negotiate a settlement or agreement that may be beneficial to both parties.
