Both New York and New Jersey are what are called at-will states, meaning that your employer can terminate you for any reason or you can leave your employer for any reason and there’s no penalty. However, that at-will provision is subject to acts of discrimination. In other words, if you were terminated because of your age and that is the motivating factor of the employer, it doesn’t matter if it’s an at-will state or not. You would have a claim for discrimination, anyway. An employer cannot discriminate against you because of your age or some other characteristic.
