After you file a complaint with either the Equal Employment Opportunity Commission or one of the state agencies in New York or New Jersey, the case gets assigned to an investigator. The investigator then takes the complaint, sends it to the employer, who gets a chance to respond to the complaint, which you get to see. That’s a really good process, that you actually have the administrative response prior to filing a lawsuit. You have about 180 days under the federal law, and state law could vary on the time that it takes for them to respond to the complaint.
